W Ketchup Demands the Senate Reject the Nomination of Elena Kagan to the Supreme Court

Eagle Bridge, NY — August 3, 2010 — On May 26, 2010 President Barack Obama nominated Elena Kagan to the Supreme Court. Ms. Kagan has been associated with Princeton, Oxford, Harvard Law School, the University of Chicago Law School, and the Clinton Administration. Kagan worked as a junior associate at a Washington D.C. law firm and as an advisor to Goldman Sachs. She has no other experience in the private sector. She has no judical experience.

Ms. Kagan was appointed Dean of Harvard Law School in 2003. While Dean, Kagan banned the military from recruiting on campus. Referring to the Clinton Administrationís “don’t ask, don’t tell” policy regarding homosexuals, Kagan wrote an email to the students and faculty saying: “I abhor the military's discriminatory recruitment policy. [It is] a†profound wrong ó a moral injustice of the first order.” Kagan’s ban was illegal, being in direct violation of the Solomon Amendment.

As Dean of Harvard Law School, Kagan accepted $20 million from the Saudi royal family to expand the Islamic Legal Studies Program, in particular sponsoring Sharia compliant finance. Kagan hired Noah Feldman who has argued for Islamists to take over democratic governments to impose Sharia law. Kagan also awarded the school’s Medal of Freedom to Iftikhar Chaudhry, chief justice of Pakistan. Chaudhry recently imposed Sharia law across the Pakistani government. Sharia law considers homosexuality a capital offense.

W Ketchup CEO Dan Oliver commented: “It may seem inconsistent for Kagan to break the law in order to protect homosexuals against discrimination while simultaneously constructing the legal and financial framework to justify and enable radical Muslims to kill them. But the unifying theme of the Progressive movement, of which Obama, Sotomayor, and Kagan are fellow travelers, is a hatred of America and its values. The Progressive movement is anti-family, anti-gun, anti-military, anti-self-sufficiency, and pro-America’s enemies. Kagan’s past demonstrates that this will be her stance on the court if confirmed.”

Oliver continued: “Senators and other government officials are sworn to defend the constitution from all enemies, foreign and domestic. Any senator, of either party, who votes to confirm Kagan is clearly violating his oath. We urge all Americans to eject such senators in the November elections.”



During Kagan’s confirmation hearings, Senator Coburn asked if Congress has “the power to tell people what they have to eat every day?” Kagan responded: “It sounds like a dumb law, but . . . I think that courts would be wrong to strike down laws that they think are senseless just because they're senseless.” Prodded by Coburn, Kagan was unable to state that the Constitution prevents the Congress from regulating American’s eating habits.

The Constitution lists several enumerated powers that the Congress may exercise. Eating habits are not included in the list. The tenth amendment reads: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
