W Ketchup™ Demands to Know Why Clinton has not been Arrested

Eagle Bridge, NY — March 23, 2014 — On March 11, 2015, W Ketchup™ demanded the arrest of Hillary Clinton after the former Secretary of State publically confessed to committing multiple felonies. W Ketchup™ cited regulations promulgated under 18 U.S.C. 2071 that prohibit the concealment of government records and stipulates that violators should be imprisoned for up to three years.

Clinton has admitted that she deleted 31,830 emails, which also violated 36 CFR 1230.10, a regulation that requires heads of Federal agencies prevent the destruction of records.

On March 16, law professor Ronald Rotunda wrote an op-ed in the Wall Street Journal pointing out that it is also a federal crime under 18 U.S.C. 1519 to destroy even one email to prevent it from being subpoenaed, and that Hillary herself voted for this law as a senator. The courts have interpreted this law to mean that prosecutors “need only prove that the defendant shredded the documents, at least in part, to make life more difficult for future investigators, if and when they eventually appear.” Such “anticipatory obstruction of justice” carries a prison sentence of up to 20 years.

During an interview in 2000, Clinton proclaimed: “As much as I've been investigated and all of that, you know, why would I - I don't even want - why would I ever want to do e-mail?”

Hillary Clinton worked on the House Impeachment Committee during the Nixon Administration, which warned Nixon not to destroy his records or face indictment for obstruction of justice.

Dan Oliver, CEO of W Ketchup™, charged: “Hillary saw first-hand that the only thing they might have on Nixon were contained in his own records, and she determined not to repeat his mistake. But it is impossible to function in the modern world without email, so she committed multiple felonies to conceal her records instead.”

All employees departing the State Department are required to sign form OF-109, a declaration that the departing employee has turned over all relevant records at the time of departure, and which stipulates prison time for failure to do so. The State Department has not denied Clinton signed her form OF-109, but has said it has no record of it.

W Ketchup™ Chairman Bill Zachary reacted: “At his first inauguration, Mr. Obama declared: ‘Transparency and the rule of law will be the touchstones of this presidency.’ Obama has since declared he will not enforce the immigration laws, violating his oath of office, and he now refuses to hold Clinton accountable for her confessed felonious behavior. Leona Helmsley famous remarked that taxes are for the little people. For Democrats, it appears now that all laws are only for the little people.”

Clinton is a defendant in several Freedom of Information Act lawsuits. The destruction of documents subject to discovery in such a suit is a Federal crime.
