The founders of our republic fashioned the Constitution to provide for limited government. Section 8 of Article 1 of the Constitution constrains Federal action to specific, enumerated powers. One such power is to regulate commerce “among the several states.” The word “among” so clearly limits this power from molesting activities wholly within a state that James Madison considered the power one “from which no apprehensions are entertained.” In 1938, Franklin Roosevelt had a federal law passed limiting the amount of wheat a man could grow on his own land. Roscoe Filburn grew more wheat than the government dictated and, even though all of the wheat was consumed on his own farm and was never sold, he was prosecuted under the law. The law was clearly unconstitutional because Filburn's wheat did not cross state lines, but Roosevelt's justices declared that because Filburn grew the wheat he consumed, he did not buy more wheat, which affected the price of wheat, which had interstate consequences. Therefore, they upheld the law as constitutional. Daniel Oliver, CEO of W Ketchup™, remarked: “Two thousand years ago, Aristotle warned that ‘it is by small degrees only that one thing takes place of another; so that the ancient laws will remain, while the power will be in the hands of those who have brought about a revolution in the state.’ Wickard v. Filburn was the triumph of the second, stealth, malevolent American revolution. After this ruling, the state could use the Commerce Clause to regulate any activity. It had more power than King George III could dream, and it used it.” Last week, the Supreme Court delivered its opinions on the constitutionality of Obamacare. The key provision of this law forces all Americans to buy medical insurance: non-complying citizens will be fined. Chief Justice Roberts voted to hold the mandate unconstitutional, but, according to CBS News, he succumbed to “external pressure” from liberal news sources and ruled Obamacare was valid under the taxing power of the Sixteenth Amendment. W Ketchup™ Chairman Bill Zachary reacted: “It is well known that justices appointed by Republicans eventually turn leftist in order to be invited to posh parties and be fawned on by establishment media. Sadly, Justice Roberts has revealed himself to be weak and common. Roberts has cemented his legacy.” Justice Robert's opinion was completely idiosyncratic. The liberal justices joined the results but not his reasoning, while the other justices rejected both. For law-abiding citizens, it makes little difference whether the state enforces its edicts through confiscation of property or imprisonment. Those principled Americans who refuse to pay the tax/penalty will face large civil fines enforced by the Internal Revenue Service, depriving them of their liberty. Oliver added: “If Wickards v. Filburn allowed the government to regulate any economic activity, the Obamacare decision allows the state to regulate inactivity as well. There are now no limits on federal power. The age of American fascism has arrived.” Mr. Obama recently announced that his reelection slogan is “Forward!” This slogan has been used previously by Stalin, The Hilter Youth, and Chairman Mao during China's Great Leap Forward. Forward! was also the title of Vladimir Lenin's publication and the name of a newspaper edited by Benito Mussolini.
